Monmouth County , NJ Woman Settles Trip and Fall for $600k

The Plaintiff, in her late 50s, tripped and fell on a county-maintained sidewalk in Monmouth County, NJ. Her fall resulted in an injury, which the plaintiff alleges was caused by the borough's negligence for failing to maintain the walkway. Her injury required surgery, after which she suffered a GI bleed, anemia and contracted a C-Diff infection. She currently still suffers from a 1/2 inch leg discrepancy, and cannot have the prescribed hip replacement surgery that doctors recommended because of a prior health condition. The plaintiff contended that the sidewalk's pavers had a propensity to settle and that the borough, which installed the sidewalk years earlier, should have conducted periodic inspections and maintenance to ensure the sidewalks safety. The municipality concealed that it had not received any complaints, when in fact it had, and denied acting in a unreasonable manner. The plaintiff also named the abutting commercial landowner, arguing that the landowner should have recognized that a hazard was developing in the years since the sidewalk was installed.

The case settled prior to trial for $600,000, including $125,000 from the borough, and $475,000 from the abutting property owner.

Attorney for plaintiff: Randolph H. Wolf, Esq.

Timeline of Key Moments in the Casey Anthony Case

Casey Anthony has been booked into the Orange ...Image via Wikipedia

In perhaps one of the most highly publicized court cases in recent history, Casey Anthony was tried and found not guilty of the murder of her 3-year-old daughter. The verdict was met with anger and disgust by the viewing public – but the jury claims there was just not enough evidence to convict the young mother. Let’s take a look back at the noteworthy events that took place over the past three years of Casey Anthony’s tumultuous life:

July 15, 2008: Caylee Anthony’s grandmother, Cindy, reported that Caylee had been missing for 31 days.

July 16, 2008: Casey Anthony was arrested for the first time.

July 17, 2008: Anthony was charged with false statements, child neglect and obstruction of a criminal investigation.

August 21, 2008: She was released after her $500,200 bond was posted.

The attorneys over at the Gertler firm have helped many people in the state of Louisiana with medical malpractice and  personal injury cases over the years.  Take a look at this testimonial below from Mark S. and the complete list on their site: http://www.gertler-law-firm.com/client-success-stories.html

Mark S. – Asbestos Lung Disease Case
Quite frankly, the Gertler firm saved my life.  They walked me through every step in all my lawsuits and took their time to explain everything in detail in order to make the proper decisions.  Endless hours were taken by the firm to explain every document I was to sign.

Also, the staff was wonderful to me and kept me organized and reminded me of all things I needed to be doing.  I owe them my life.  I trust them implicitly.  They are an all-purpose law firm.

NJ Auto Accident Settlement: 1.1 million dollars

same as Image:Gray 111 - Vertebral column.png ...Image via WikipediaNew Jersey accident attorney Randolph H. Wolf recently settled out of court for 1.1 million dollars on behalf of a New Jersey man in his 50s injured in an auto accident. The man claimed he was struck by the defendant driver while the defendant was attempting to make a left turn out of his driveway. The driveway was lined with tall bushes and trees which obstructed the defendant's view, resulting in the collision with the plaintiff. As a result, the plaintiff maintained that as a result, he suffered herniated disks in his spinal column that required surgery, suffered from a concussion, and still continued to have anxiety and nightmares about the crash. Due to the crash, the plaintiff was unable to work and had sued for physical property damage, medical expenses relating to his care, and future lost wages. The man had originally sought $1.25M and settled for $1.1M.

Bloomberg Rogue on Education!!!

How can you possibly justify putting someone with no relevant experience in such an important post?

Why don't you hire me as your pilot for your next flight then? You think this woman can fathom the horrors of inner city schools? You think she will understand educators when they speak?

Time will tell, but its not looking good Bloomberg.

Be Thankful You are NOT Starving Right Now!

Its one of the greatest lessons we could ever learn. Be thankful for every breath, every moment, every interaction….because there are many who would give everything for that one breath. One more moment with their loved ones.

Be thankful that you are reading this and not one of the 10,000 children who will die today because of global poverty. Even much of America lives below the poverty line these days. Be thankful that you can join me in helping these people! feedingamerica.org

In turn, you will be helping yourself, your family and our entire global society.

$100 Million Verdict for an Illinois Truck Accident Lawsuit by Power Rogers & Smith

metal coilImage by Bob L2008 via Flickr
This one is particularly difficult to report on since six children from one family died. The plaintiffs were traveling in their minivan when it caught fire after the vehicle's gas tank was ruptured by a metal taillight assembly that had fallen from a truck.

Our condolences go out to the family who lost so much. As a former truck driver I can rant for days about the dangers posed to drivers and other motorists. From experience I have learned to stay away from other vehicles whenever possible and always try to expect the unexpected. Our highways have become extremely hazardous due to tire blowouts, sleepy & distracted drivers and road hazards so please drive carefully!

The case was fought by the legal team at Power Rogers & Smith, who have a great track record of successful verdicts.

3 Personal Injury Verditcs over 10 Million: Attorney Edward Scher

$14.25 million settlement

The plaintiff was severely injured and permanently incapacitated as a result of a product defect.

This case involved multiple corporate defendants and took several years to complete. The trial was scheduled to last more than a month. The case settled soon after the trial began. The specifics of the case are confidential.

Reported at Virginia Lawyers Weekly, June 15, 2009, page 29.

$12.2 million jury verdict

A convenience store allowed a dangerously slippery condition to exist on its sidewalk. The client had no warning of the danger. She slipped on it and fell, and suffered a traumatic brain injury as a result. The jury returned its verdict after seven days of trial.

This was reportedly the largest personal injury jury verdict in Virginia in 2007. Virginia Lawyers Weekly described it as "unprecedented."

Reported at Virginia Lawyers Weekly, May 7, 2007 (front page); July 2, 2007; and January 14, 2008 (front page and listing of largest jury verdicts on page 5).

$10.2 million jury verdict

The plaintiff was a passenger in a car traveling on an interstate highway. A tractor-trailer rear-ended the car, sending it spinning and rolling. The plaintiff had a prior history of brain injury and suffered additional brain injury. The trial took nine days; the jury returned its verdict on the tenth day.

This was reportedly the largest personal injury verdict in Virginia in 2008.

Reported at Virginia Lawyers Weekly, August 11, 2008 (front page); and Virginia Lawyers Weekly list of largest verdicts of 2008.

About the Firm:
